COPYRIGHT NOTICE, INTELLECTUAL PROPERTY POLICY, AND TERMS OF USE

1. Ownership and Scope
These Copyright Notice, Intellectual Property Policy, and Terms of Use (“Terms”) apply to TVPMM.com, TVMUSICMUSEUM.com, TVPMMVAULT.com, MOTPM.com, MUSEUMOFTELEVISIONPRODUCTIONMUSIC.com, MOTPMFORUM.com, TELEVISIONCOMPOSERS.com, and SAVEOURSONGS.com, together with all associated webpages, databases, archives, media players, soundbanks, videobanks, imagebanks, files, services, and digital resources operated by or on behalf of the Museum of Television Production Music (collectively, the “Websites”).
The Websites, including their original text, research, descriptions, annotations, cataloging, metadata, databases, selection and arrangement of materials, graphic design, logos, trademarks, trade dress, software, source code, interfaces, and other original content, are protected by applicable United States and international copyright, trademark, database, unfair-competition, and other intellectual-property laws.

Certain historical recordings, musical compositions, photographs, videos, program excerpts, artwork, trademarks, names, and other archival materials displayed or referenced on the Websites may remain the property of their respective composers, performers, publishers, production companies, networks, studios, photographers, estates, licensors, or other rights holders. Such materials are presented for legitimate archival, historical, educational, scholarly, research, commentary, identification, and preservation purposes. Nothing on the Websites represents that the Museum owns every underlying work represented in its collections.
All copyrights, trademarks, publicity rights, and other proprietary rights belonging to third parties are acknowledged and remain vested in their respective owners. The inclusion of third-party material does not constitute an endorsement, sponsorship, affiliation, transfer of ownership, or waiver of any rights.
2. Limited Permission to Access the Websites
Subject to continued compliance with these Terms, visitors are granted a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable permission to access and view publicly available Website content solely for lawful, personal, noncommercial research, historical, educational, or informational purposes.
This limited permission authorizes viewing only. It does not authorize downloading, extracting, recording, copying, reproducing, publishing, transmitting, redistributing, publicly displaying, publicly performing, modifying, adapting, synchronizing, licensing, selling, exploiting, or creating derivative works from any Website content.
Access to restricted, subscriber-only, password-protected, streamed, or otherwise controlled material does not confer ownership or any additional license or right of use.
3. Express Prior Written License Required
Except where expressly permitted by applicable law, no Website content may be used beyond the limited viewing permission stated above without an express, prior, written license executed by an authorized representative of the Museum of Television Production Music and, when applicable, any additional authorization required from the owner of the underlying material.
A valid license must specifically identify:
the content being licensed;
the authorized user or licensee;
the precise permitted use;
the approved media and distribution channels;
the duration and geographic territory of the license;
any required attribution, notices, fees, security measures, and restrictions; and
any other applicable conditions.
Oral statements, informal correspondence, prior dealings, silence, failure to object, technical accessibility, possession of a file, Website membership, subscription, payment of an access fee, or the ability to view or stream content shall not constitute permission or create any license.
No license, ownership interest, waiver, authorization, or other right is granted by implication, estoppel, acquiescence, course of conduct, Website access, or otherwise.
4. Prohibited Uses and Conduct
Unless expressly authorized through a prior written license or otherwise permitted by applicable law, you may not, directly or indirectly:
copy, capture, download, reproduce, duplicate, record, rip, archive, store, republish, upload, transmit, retransmit, broadcast, distribute, circulate, exhibit, publicly display, or publicly perform any Website content;
modify, edit, translate, remix, remaster, restore, enhance, synchronize, sample, adapt, annotate, recut, alter, manipulate, or create derivative works from Website content;
sell, resell, rent, license, sublicense, monetize, commercially exploit, advertise with, promote with, or otherwise derive revenue or commercial benefit from Website content;
place Website content on another website, application, platform, social-media account, file-sharing service, streaming service, broadcast, podcast, physical product, presentation, publication, database, archive, exhibition, or distribution system;
use Website content in connection with film, television, radio, advertising, marketing, documentaries, theatrical productions, live events, games, software, merchandise, compilations, commercial research, or promotional materials;
scrape, crawl, harvest, index, mirror, frame, aggregate, cache, extract, bulk-download, systematically collect, or create a database from Website content by manual or automated means;
use Website content, metadata, databases, recordings, images, text, or other materials to train, develop, test, fine-tune, evaluate, supply, or operate any artificial-intelligence, machine-learning, facial-recognition, voice-cloning, music-generation, content-generation, data-mining, or similar automated system;
bypass, defeat, disable, interfere with, probe, test, circumvent, or attempt to circumvent passwords, access controls, streaming protections, digital-rights-management measures, watermarks, download restrictions, robots directives, authentication systems, technical safeguards, or other security measures;
remove, conceal, crop, modify, obscure, or misrepresent any copyright notice, trademark, attribution, watermark, source identification, embedded metadata, ownership statement, or rights-management information;
falsely claim authorship, ownership, sponsorship, licensing, affiliation, authorization, or endorsement concerning any Website content;
impersonate the Museum or use its name, logos, domain names, branding, goodwill, or identifying elements in a manner likely to cause confusion;
share passwords, access credentials, protected links, authenticated sessions, downloaded files, or restricted content with unauthorized persons;
use Website content in a defamatory, deceptive, unlawful, infringing, misleading, harassing, obscene, or otherwise unauthorized manner; or
assist, encourage, facilitate, direct, or enable another person or entity to engage in any prohibited activity.
The absence of a download control, watermark, copyright symbol, warning, technological restriction, or other protective measure does not mean that material is in the public domain or available for unrestricted use.
5. Personal and Noncommercial Access Does Not Permit Copying
The Museum provides access to certain materials to support historical preservation, scholarship, education, research, commentary, and appreciation of television production music. This purpose does not grant visitors permission to reproduce, redistribute, publish, commercialize, or otherwise exploit the materials.
The Museum’s nonprofit or preservation-oriented status does not place its original content, compilation, research, databases, or licensed materials in the public domain. Likewise, a visitor’s proposed nonprofit, educational, historical, archival, fan-based, or noncommercial use is not automatically authorized and does not, by itself, establish fair use or any other legal exception.
Any person relying on fair use or another statutory exception does so at that person’s sole responsibility and risk. Questions concerning whether a particular proposed use is legally permissible should be addressed to qualified legal counsel.
6. No Ownership or Rights Granted
All rights not expressly granted in these Terms are reserved.
Viewing, accessing, streaming, subscribing to, linking to, or otherwise using the Websites does not transfer ownership of any Website content or underlying intellectual property. No visitor receives any right to reproduce, distribute, display, perform, adapt, license, exploit, or claim ownership of any material merely because that material can be accessed through the Websites.
Purchase of access, membership, subscription, research services, archive services, or any other Museum service grants only the access expressly described at the time of purchase. It does not grant reproduction, publication, synchronization, broadcast, distribution, exhibition, commercial-use, or sublicensing rights.
7. Trademarks, Names, and Branding
The Museum of Television Production Music name, its associated names, domain names, logos, designs, slogans, service names, collection names, and other identifying marks are proprietary assets of the Museum or are used with permission.
They may not be copied, imitated, registered, incorporated into another mark or domain name, used as metadata, or displayed in a manner suggesting sponsorship, affiliation, endorsement, or authorization without express prior written permission.
Third-party names, titles, logos, programs, networks, studios, and trademarks appearing on the Websites belong to their respective owners and are used for identification, reference, historical, archival, or informational purposes.
8. Preservation Mission and Support for Rights Holders
The Museum of Television Production Music is a nonprofit, preservation-oriented entity dedicated to documenting, researching, preserving, and promoting the history of music created and recorded for television productions.
Visitors are strongly encouraged to support composers, musicians, publishers, performers, estates, production companies, networks, studios, licensors, and other rights holders by obtaining authorized releases and legally purchasing, licensing, viewing, or otherwise engaging with their works and services through legitimate channels.
The Museum does not represent that its archival presentation replaces an authorized commercial release or license.
9. Accuracy, Availability, and Changes to Content
The Websites and their contents are provided on an “as is” and “as available” basis for archival, historical, educational, research, and informational purposes.
The Museum makes reasonable efforts to present accurate information but does not warrant or guarantee that any content, attribution, date, title, credit, description, metadata, recording, image, document, link, or other information is complete, current, error-free, uninterrupted, or suitable for any particular purpose.
The contents and organization of the soundbanks, videobanks, imagebanks, databases, archives, and other collections may be corrected, revised, expanded, restricted, relocated, suspended, or removed at any time without notice.
To the fullest extent permitted by law, the Museum disclaims all express and implied warranties, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, and noninfringement.
10. Third-Party Rights and Good-Faith Copyright Concerns
The Museum respects the intellectual-property rights of composers, performers, publishers, photographers, producers, networks, studios, estates, licensors, and other rights holders.
A person who believes that material appearing on the Websites infringes a copyright or other proprietary right should provide a written notice identifying:
the person submitting the notice and that person’s authority to act;
the copyrighted or protected work claimed to have been infringed;
the specific Website material at issue and its exact URL;
sufficient contact information;
the nature and basis of the claimed rights;
the requested action; and
a statement that the information supplied is accurate and submitted in good faith.
Knowingly false, misleading, or materially incomplete claims may be rejected and may have legal consequences. Submission of a complaint does not establish ownership, infringement, or an automatic entitlement to removal.
Copyright inquiries and licensing requests should be directed through the official contact information published on the Websites.
11. Enforcement and Remedies
Unauthorized use of Website content may constitute infringement, breach of contract, circumvention of technological protections, removal or alteration of copyright-management information, misappropriation, trespass, unfair competition, or violation of other applicable laws.
The Museum reserves the right, without prior notice and in addition to all other available rights and remedies, to:
suspend, restrict, or permanently terminate Website access;
deactivate accounts, passwords, links, or subscriptions;
preserve access records, server logs, communications, and other relevant evidence;
issue cease-and-desist demands and takedown notices;
notify hosting providers, internet-service providers, platforms, payment processors, employers, licensing organizations, or appropriate authorities;
seek temporary, preliminary, and permanent injunctive relief;
seek impoundment, removal, destruction, or disabling of unauthorized copies;
recover actual damages, infringer’s profits, statutory damages when available, costs, and attorneys’ fees when authorized by law; and
pursue any additional civil, equitable, administrative, or criminal remedies available under applicable law.
The Museum’s failure or delay in enforcing any right shall not constitute a waiver. A waiver is effective only when made expressly and in writing by an authorized representative of the Museum, and any waiver shall apply only to the specific matter identified.
12. Reporting Unauthorized Use
The Museum welcomes reports of suspected copying, unauthorized publication, redistribution, commercial exploitation, circumvention, credential sharing, impersonation, or other misuse of Website content.
Reports should identify the material involved, the location of the suspected unauthorized use, the date discovered, and any available supporting documentation. The Museum may investigate such reports but is not obligated to disclose investigative methods, enforcement decisions, or privileged communications.
13. Links to the Websites
Ordinary text links to publicly accessible Website pages may be permitted provided that the link:
does not reproduce or frame Website content;
does not bypass access controls or link directly to protected media files;
does not imply sponsorship, endorsement, partnership, or affiliation;
does not use the Museum’s trademarks or logos without permission; and
is not presented in a misleading, unlawful, defamatory, or commercially exploitative context.
The Museum may revoke permission to link to the Websites at any time.
14. Restricted Access and Account Security
Users of password-protected or restricted areas are responsible for maintaining the confidentiality of their credentials and for all activity conducted through their accounts.
Credentials are personal to the authorized user and may not be transferred, published, sold, loaned, shared, or used concurrently by unauthorized persons. Users must immediately report suspected credential compromise or unauthorized access.
The Museum may monitor access to protected systems, investigate unusual activity, impose technical restrictions, and terminate access when necessary to protect the Websites, their collections, licensors, rights holders, or users.
15. Acceptance and Modification of These Terms
By accessing, browsing, streaming, registering with, subscribing to, or using any portion of the Websites, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree, you must discontinue access to and use of the Websites.
The Museum may revise these Terms periodically by posting an updated version. Continued use after an updated version is posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
16. Severability and Reservation of Rights
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Headings are provided for convenience and do not limit the scope or meaning of these Terms.
Nothing in these Terms limits any rights or remedies belonging to the Museum, its licensors, or any third-party rights holder under copyright, trademark, contract, privacy, publicity, unfair-competition, or other applicable law.
